Welcome to Motionspire. These Terms of Service (the “Terms”) govern your access to and use of the Motionspire website, digital content, virtual fitness session support, and related services (together, the “Services”). By accessing, browsing, subscribing to, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.
Acceptance of these Terms
These Terms form a binding agreement between you and Motionspire. They apply to every visitor, member, and subscriber. Your continued use of the Services after any update constitutes acceptance of the revised Terms, so we encourage you to review this page periodically.
About our Services
Motionspire provides online fitness and general-wellness activity content, including guided movement routine content, educational wellness materials, virtual fitness session support, and the preparation of digital activity resources for online platforms.
All of our Services are educational and general-wellness focused in nature. They do not include medical treatment, physical therapy, nutritional counseling, or licensed healthcare services, and nothing within the Services should be relied upon as professional or clinical advice.
Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or purchase a subscription. By using the Services you represent that you meet this requirement and that the information you provide is accurate and complete. Minors may use the Services only under the supervision of a consenting parent or legal guardian.
Your account
Certain features may require you to register for an account. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You agree to:
- Provide accurate, current, and complete information during registration;
- Keep your password confidential and not share access with others;
- Notify us promptly of any unauthorized use of your account;
- Accept responsibility for activity carried out through your account.
License to use digital content
Subject to these Terms and any applicable subscription, Motionspire grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use our digital content for your own non-commercial wellness purposes. You may not copy, redistribute, resell, sublicense, publicly display, or create derivative works from our content without our prior written permission.
Subscriptions, billing, and renewals
Some Services are offered on a subscription basis or as one-time purchases. Pricing is presented at the point of purchase. Where a subscription renews automatically, it will continue until cancelled in accordance with our Digital Content & Subscription Policy. Refund eligibility is described in our Refund Policy. Both policies are incorporated into these Terms by reference.
Virtual sessions and community conduct
When you take part in virtual group activity sessions or other participation-based features, you agree to follow our Community / Virtual Session Guidelines. We may remove participants who act disruptively, unsafely, or in a manner that harms the experience of others.
Intellectual property
The Services and all associated content, including text, graphics, illustrations, logos, video, audio, software, and the overall design, are owned by Motionspire or its licensors and are protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you.
Acceptable use
When using the Services, you agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose;
- Attempt to gain unauthorized access to any part of the Services or related systems;
- Interfere with, disrupt, or place undue load on our infrastructure;
- Upload or transmit malicious code, or scrape content using automated means without permission;
- Misrepresent your identity or impersonate any person or organization.
Health and safety acknowledgement
You acknowledge that participation in physical activity carries inherent risks. Our content is general in nature and is not tailored to your individual medical circumstances. You should consult a qualified healthcare professional before beginning any new activity, and you agree to move within your own limits and stop if you experience pain, discomfort, or distress. Participation is entirely voluntary.
Third-party links and services
The Services may reference or link to third-party websites, platforms, or tools that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of such resources is at your own risk and subject to their terms.
Disclaimer of warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular outcome will be achieved.
Limitation of liability
To the fullest extent permitted by law, Motionspire and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the Services. Where liability cannot be excluded, it is limited to the amount you paid for the Services in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Motionspire and its personnel from any claims, damages, liabilities, and expenses arising out of your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.
Suspension and termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or use the Services in a way that may cause harm. You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply.
Changes to these Terms
We may update these Terms from time to time to reflect changes in our Services or applicable law. When we do, we will revise the “Last updated” date above. Material changes will be communicated through the Services where appropriate.
Governing law and dispute resolution
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-laws principles. You agree that any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Kentucky, unless otherwise required by applicable law.
Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right does not waive that right. You may not assign these Terms without our consent. These Terms, together with the policies referenced within them, constitute the entire agreement between you and us regarding the Services.
